His lawyers are working to prevent it from being used as proof in his legal proceedings in DC in 2025.

Legal Battle

In response, lawyers from the US Department of Justice have said they can establish in legal proceedings that the admission was "unforced, reliable and truthful."

The availability of the defendant's alleged admission was originally revealed in 2020, when the United States declared it was charging him with constructing and activating the explosive device utilized on Flight 103.

Defense Claims

The defendant is accused of being a previous official in Libyan intelligence agency and has been in American confinement since 2022.

He has pleaded not guilty to the allegations and is scheduled to appear in court at the US court for the District of Columbia in the coming months.

His attorneys are trying to stop the court from learning about the confession and have presented a petition asking for it to be suppressed.

They argue it was acquired under pressure following the overthrow which removed the Libyan leader in the early 2010s.

Purported Coercion

They claim ex- members of the ruler's government were being singled out with illegal killings, kidnappings and torture when the suspect was abducted from his dwelling by armed individuals the following period.

He was transported to an unregistered detention center where other prisoners were reportedly assaulted and mistreated and was isolated in a cramped room when three masked individuals handed him a single page of documentation.

His attorneys said its manually written contents started with an command that he was to confess to the Lockerbie incident and another terrorist incident.

Substantial Terror Incidents

The suspect states he was instructed to learn what it indicated about the events and restate it when he was questioned by someone else the following time.

Being concerned for his safety and that of his family, he stated he thought he had no alternative but to acquiesce.

In their answer to the defense's request, attorneys from the federal prosecutors have stated the tribunal was being asked to withhold "very pertinent testimony" of the suspect's responsibility in "multiple significant terrorist events directed at American people."

Authorities Counterarguments

They assert the defendant's version of events is unbelievable and untrue, and argue that the information of the admission can be supported by credible external evidence assembled over numerous years.

The government attorneys claim the suspect and other former personnel of the former leader's intelligence service were held in a secret holding center managed by a faction when they were interrogated by an seasoned Libyan law enforcement official.

They contend that in the turmoil of the aftermath period, the center was "the most secure environment" for the suspect and the other agents, considering the hostility and resistance attitude dominant at the moment.
